ARGUMENT: THE HOSTILE ADMISSION OF ANDREW JOHNSON
The identity of the Beneficiaries is proven by the Veto of Andrew Johnson. He admitted the Act made “citizens of the colored race.” By overriding this veto, Congress constitutionally rejected the President’s attempt to exclude this class. This “Hostile Admission” proves that the 14th Amendment was never meant to be narrowed by executive whim.
