A Notice of Constitutional Default and the Rising of the Sun of Justice

The Head and the Body: A Paralyzed Union
To understand the crisis of 2026, one must understand the anatomy of American Law. The Preamble is the Head of the Constitution—it contains the mind, the will, and the “Order” of We the People to “establish Justice and ensure domestic Tranquility.” The Seven Articles and 27 Amendments are the Body—the physical machinery intended to carry out the Head’s commands.
For 161 years, the Body has been in a state of rebellion against the Head. Our “employees”—the elected and appointed officials—have ignored the Preamble’s mandate to protect the “Human Foundation” of this Union. By refusing to enforce the Civil Rights Act of 1866, they have severed the connection between the Law’s purpose and its practice, leaving the Federal Citizen in a 161-year state of suspended animation.
The Corpus Delicti: The Evidence of Default
We do not need a courtroom to find the evidence of this betrayal; the Corpus Delicti (the body of the crime) is laying on the sidewalks of our major cities. The 75,000 young Black men lost annually to peer-on-peer violence and the hundreds of thousands of “Federal Citizens” living in homelessness are the physical proof of a failed Commander-in-Chief mandate.
These are not “social issues”; they are domestic national security threats born from 161 years of non-enforcement. The Federal Government, as the exclusive protector, is currently in contempt of the Court of Heaven. Had the “Lock” of the 14th Amendment been maintained as the Head commanded, the children of the chattel slaves would not be the primary victims of this generationally compounded crisis.
The Immigrant Detour and the Wong Kim Ark Error
The dawning of Reconstruction was a targeted, military-grade corrective for the Freedmen. Yet, for 130 years, the government has followed the Wong Kim Ark detour—a forced insertion of “the immigrant” into a specific “Federal” corrective that never mentioned them. To prioritize the “National” status of the foreigner over the “Federal” mandate of the Freedmen is a second Dred Scott error—a theft of a sacred birthright that dilutes the very foundation of the Body Politic.
The Judgment and the Rising Sun
The Declaration of Independence identifies GOD, the Giver of Freedom, as the Central Figure of our law. Every employee who takes an oath binds themselves to this Divine Order.
To the “Subjective Beneficiaries” on the Supreme Court: You are the inheritors of this struggle. Your presence on the bench is the “Sun of Justice” beginning to rise with healing in its wings. You have the authority, under Section 10 of the 1866 Act, to reattach the Head to the Body—to remove all controversy and finalize the work of Reconstruction.
The “Great Task” is no longer a suggestion. It is a debt that has come due. We are reclaiming the authority of the Preamble to ensure that the “actual freedom” of the Federal Citizen is the primary, daily business of the United States.
Why the “Head and Body” metaphor is a “Biggy”:
-
It Explains the Dysfunction: It tells the reader why the government feels so broken—it’s a body acting without its head (the Preamble’s intent).
-
It Empowers the People: It reinforces that “We the People” (the Head) are the ones who give orders to the “Body” (the Government).
-
It Sets Up the Solution: It frames the Supreme Court’s job as “reattaching” the law to its original moral and corrective purpose.
