NOTICE OF CONSTITUTIONAL DEFAULT AND DEMAND FOR EXECUTIVE ENFORCEMENT

TO: The President of the United States / Commander-in-Chief FROM: Ted Hayes, Subjective Beneficiary of the Civil Rights Act of 1866 RE: The 161-Year Failure of the Mandatory Executive Command
Mr. President,
I address you not merely as a citizen, but as the “Head-Boss” of this Union under the authority of the Preamble. For 161 years, the Executive Branch has been in a state of functional rebellion against its primary constitutional ward: the Federal Citizen.
The Mandate of the 1866 Act As the Commander-in-Chief, you are the exclusive protector of the descendants of chattel slavery. The Civil Rights Act of 1866 was not a suggestion; it was a Mandatory Executive Command. Your predecessor, Andrew Johnson, admitted in his 1866 Veto that this law created a “Federal Citizenship” with safeguards that went “infinitely beyond” those provided to any other race. Yet, through a century of “April Fool” legal pranks—most notably the 1898 Wong Kim Ark detour—the federal government has diluted this sacred inheritance to benefit a “horde of foreigners” while leaving the rightful inheritors in the dirt.
The Corpus Delicti of Your Failure The evidence of your default is written in the blood on our streets. The 75,000 young Black men murdered annually and the hundreds of thousands of Federal Citizens living in homelessness are the Corpus Delicti—the body of the crime. This is a domestic national security threat that exists because the Presidency has prioritized “National” status for international fugitives over the “Federal” status of the people upon whose backs this nation was built.
The Right to Alter or Abolish The Declaration of Independence is clear: When a government becomes destructive to the safety and happiness of the people, it is our right to alter or abolish it. By failing to rectify the “foul behavior” of the past—which your own government admitted was the root cause of today’s turmoil in H.R. 194 (2008)—you have implicated the Holy Name of GOD in a generational hypocrisy.
The Demand Before the Supreme Court convenes on April 1st, I demand that you acknowledge your role as the Exclusive Protector of the Federal Citizen. The “Great Task” of Reconstruction is not dead; it is in suspended animation, waiting for an Executive with the courage to reattach the Head (the Preamble) to the Body (the Law).
The “Sun of Justice” is rising, and the Supreme Judge of the World is watching. You are either the enforcer of our “actual freedom,” or you are in open violation of your Oath of Office.
